§1 Definicje

a) Szkoła Językowa UP2 Academy – szkoła językowa, której właścicielem jest usługodawca.

b) Usługodawca – właściciel Szkoły Językowej UP2 Academy, Przemysław Wajrak prowadzący działalność gospodarczą pod firmą UP2 Academy Przemysław Wajrak, Calle Oviedo 121/2D, 50007, Saragossa, Hiszpania; NIF: Z0843143Z.

c) Usługobiorca/Uczeń – osoba fizyczna uprawniona do uczestniczenia w Kursie a) posiadająca pełną zdolność do czynności prawnych albo b) która ukończyła 16 lat i posiada ograniczoną zdolność do czynności prawnych, pod warunkiem uzyskania uprzedniej zgody jej przedstawiciela ustawowego na jej uczestnictwo w Kursie i zawarcie umowy w tym zakresie.

d) Konsument – pełnoletnia osoba fizyczna posiadająca pełną zdolność do czynności prawnych dokonująca zakupu usługi w zakresie niezwiązanym bezpośrednio ze swoją działalnością gospodarczą lub zawodową.

e) Usługa – nauczanie języka obcego metodą UP2, prowadzone przez nauczyciela lekcje oraz lekcje uzupełniające, a także dostęp do platformy edukacyjnej.

f) Kurs/pakiet – rodzaj Usługi oferowany przez UP2 Academy. Odnosi się do lekcji indywidualnych, które składają się z: 60-minutowych lekcji na żywo online, dostępu do platformy edukacyjnej w jednym z 5 trybów: General English, Business English, Exam Course, Speaking, Individual.

g) Metoda – sposób w jaki przebiega nauka języka obcego w UP2 Academy i który jest optymalny pod względem efektywności i który powinien być przestrzegany przez ucznia.

h) Pakiet – zestaw 1, 4 lub 8 lekcji indywidualnych.

i) Rozdział – jednostka podziału kursu, na który składają się minimum 3 podrozdziały

j) Platforma Edukacyjna – serwis internetowy Szkoły Językowej UP2 Academy  znajdujący się pod adresem https://edu.up2academy.com/, który zawiera ćwiczenia do każdego Modułu oraz dziennik aktywności Ucznia.

k) Semestr – okres trwający 6 miesięcy, liczony od daty pierwszej lekcji lub  zaksięgowania płatności/przelewu.

l) Miesiąc – okres wynoszący 30 dni, liczony od daty pierwszej lekcji z danego pakietu do jego końca

m) Okres Przejściowy – okres obowiązujący od końca danego pakietu do początku kolejnego, który może wynieść od minimum jednego do siedmiu (7) dni, licząc od daty ostatniej lekcji z danego pakietu i/lub od daty wygaśnięcia ważności pakietu.

n) No Show – określenie opisujące niestawienie się o umówionej godzinie lekcji, bez uprzedniej informacji o jej odwołaniu, równoznaczne z uznaniem danej lekcji za zaliczoną.

o) Late Cancel – określenie opisujące odwołanie lub przełożenie umówionej lekcji w czasie krótszym niż 12 godzin od godziny jej rozpoczęcia.

p) UP2 Booking – strona internetowa umożliwiająca samodzielną rezerwację terminów zajęć, jak i wgląd w dostępność terminów, znajdująca się pod adresem: https://booking.up2academy.com.

q) Iloczyn – wskaźnik określający ilość pomnożonych przez cenę standardową lekcji

r) Trwały Nośnik – wiadomość elektroniczna przesłana na adres elektroniczny Usługobiorcy podany w trakcie Zamówienia, umożliwiająca Usługodawcy przekazanie Usługobiorcy informacji na temat Zamówienia, którą będzie można w przyszłości odtworzyć w postaci niezmienionej.

s) Zamówienie – oświadczenie Usługobiorcy składane za pośrednictwem serwisu internetowego Szkoły Językowej UP2 Academy znajdującego się pod adresem https://up2academy.com, wyrażające wolę zawarcia umowy o świadczenie usług edukacyjnych.

t) Umowa – umowa o świadczenie usług w rozumieniu art. 1254 hiszpańskiego Kodeksu cywilnego, zawierana przez Usługodawcę z Usługobiorcą z wykorzystaniem środków porozumiewania się na odległość, w tym za pomocą wiadomości e-mail i formularzy dostępnych na stronie internetowej Szkoły Językowej UP2 Academy.

u) UP2 Shop – platforma sklepu internetowego, która oferuje kursy językowe UP2 Academy oraz umożliwia dokonywanie płatności internetowych poprzez przelew, Blik, karty kredytowe oraz GPay, dostępna pod adresem https://shop.up2academy.com.

§2 Postanowienia ogólne

1. Właścicielem szkoły językowej UP2 Academy jest Przemysław Wajrak prowadzący działalność gospodarczą pod firmą UP2 Academy z siedzibą Calle Oviedo 121/2D, 50007 Saragossa, Hiszpania; adres do korespondencji w Polsce: Skrzynice Pierwsze 101, 23-114 Jabłonna; NIP: 7133006732, REGON: 385494334; telefon: +48 883 119 228, e-mail: p.wajrak@up2academy.com
2. Przed rozpoczęciem korzystania z Usług oferowanych przez UP2 Academy należy zapoznać się ze wszystkimi postanowieniami niniejszego Regulaminu, który można pobrać, utrwalić oraz wydrukować. Korzystanie z Usług oferowanych przez UP2 Academy oznacza akceptację niniejszego Regulaminu oraz Polityki Prywatności. Warunkiem złożenia zamówienia (zawarcia umowy) jest wcześniejsze potwierdzenie zapoznania się z treścią Regulaminu.
3. Niniejszy Regulamin został wydany m. in. na podstawie art. 2 LSSI-CE (Ley 34/2002) oraz Real Decreto Legislativo 1/2007, zwłaszcza art. 103–107 (z nowelizacją przez Ley 3/2014).
4. Niniejszy Regulamin zawiera warunki i zasady zawierania Umów sprzedaży Usług UP2 Academy. Usługodawca zastrzega sobie prawo do dokonywania zmiany cen oferowanych przez siebie Usług, wprowadzenia nowych Usług do oferty, przeprowadzania, odwoływania bądź wprowadzania zmian do akcji promocyjnych na stronie Usługodawcy znajdującej się pod adresem https://www.up2academy.com/. Uprawnienie, o którym mowa w zdaniu pierwszym nie wpływa na skuteczność, sposób wykonania oraz cenę złożonych wcześniej zamówień oraz akcji promocyjnych. O dokonaniu wyżej wskazanych w zdaniu pierwszym zmianach, Usługodawca informuje Usługobiorcę drogą mailową. Usługobiorca, który nie akceptuje regulaminu w zmienionej treści uprawniony jest do odstąpienia od umowy w terminie 14 dni od otrzymania wiadomości e-mail zawierającej zmieniony regulamin, drogą mailową bądź poprzez aplikację Whatsapp. W razie odstąpienia przez Usługobiorcę od umowy, umowa wygasa z dniem wpłynięcia stosownego oświadczenia.
5. Usługobiorca zobowiązany jest do niepodejmowania jakichkolwiek działań mogących wpłynąć negatywnie na poprawne funkcjonowanie strony internetowej UP2 Academy, w tym dostarczania treści o charakterze bezprawnym.

§3 Warunki realizacji usług świadczonych przez UP2 Academy

1. Wymagania techniczne

1. Do poprawnego korzystania z Usług UP2 Academy niezbędne są:
   a) Komputer stacjonarny/laptop/urządzenie mobilne;
   b) Dostęp do Internetu – prędkość minimalna – 500 kb/s;
   c) Przeglądarka internetowa – zalecana najnowsza wersja: Chrome, Mozilla, Firefox, Microsoft Edge oraz Safari (wersja 7 lub wyższa), Internet Explorer (wersja 10 lub wyższa);
   d) Kamera internetowa;
   e) Mikrofon oraz głośniki lub słuchawki;
   f) Odpowiednie oprogramowanie do udziału w lekcji – Skype z aktywnym kontem oraz do kontaktu z Usługodawcą – Whatsapp
   g) Aktywne konto poczty elektronicznej (zalecany Gmail)
2. Wszelkie wymagania techniczne powinny zostać zweryfikowane przez Usługobiorcę/Ucznia przed wykupieniem Usługi, gdyż Usługodawca nie ponosi odpowiedzialności za nieprawidłowe działanie sprzętu bądź oprogramowania po stronie Usługobiorcy/Ucznia.

2. Rodzaje kursów i usług świadczonych przez Usługodawcę

Szkoła Językowa UP2 Academy oferuje poniższe rodzaje kursów:

1. Lekcje indywidualne – w pełni spersonalizowane zajęcia w pakiecie 1/4/8 lekcji.
2. Usługodawca w ramach kursu określonego w ppkt a. zapewnia ponadto Uczniom:
   a) nieograniczony dostęp do platformy edukacyjnej 24 godziny na dobę, 7 dni w
   tygodniu
   b) opiekę nauczyciela i monitorowanie postępu ucznia (także poprzez platformę edukacyjną)
   c) dodatkowe lekcje wyrównawcze, oferowane z polecenia nauczyciela, mające na celu wyjaśnienie wątpliwości, przećwiczenie konkretnego zagadnienia i lepsze przygotowanie do następnej lekcji w ramach wykupionego pakietu zajęć
   d) możliwość bezpłatnego wykonania testu mającego na celu sprawdzenie poziomu zaawansowania Ucznia
   e) elastyczny grafik zajęć i możliwość rezerwowania lekcji w niemal dowolnym terminie (również w weekendy w przypadku pakietu 1 lekcji)
   f) materiały dydaktyczne w cenie
   g) odwołanie lub zmianę terminu zajęć – więcej szczegółów w §3 pkt IV
3. Lekcje indywidualne odbywają się w jednym z 5 trybów:
   a) General English: naukę języka angielskiego ogólnego na poziomach od podstawowego (A1, A2, A2+), poprzez średnio-zaawansowany (B1, B1+, B2, B2+) do zaawansowanego (C1, C1+, C2)
   b) Business English: angielski biznesowy od poziomu podstawowego do zaawansowanego
   c) Exam Course: kurs egzaminacyjny dla kandydatów chcących zdać jeden z egzaminów językowych Cambridge: Preliminary (B1), First (B2), Advanced (C1), Proficiency (C2) oraz dla uczniów podchodzących do egzaminu maturalnego (podstawowego i rozszerzonego)
   d) Speaking: zajęcia z naciskiem na mówienie: poprawa wymowy, nauka technik płynności mówienia, wyeliminowanie najczęstszych błędów leksykalnych i gramatycznych, nabranie pewności siebie, przygotowanie do rozmów kwalifikacyjnych oraz autoprezentacji
   e) Individual: zajęcia w pełni spersonalizowane i dopasowane do potrzeb, które wykraczają poza zakres powyższych kursów (korepetycje z materiału bieżącego ze szkoły lub uczelni, język branżowy, pomoc metodyczna pod kątem kursów TKT, CELTA, Delta)
4. Uczeń powinien wybrać odpowiedni tryb zajęć przed rozpoczęciem kursu, a w razie wątpliwości, powinien zasięgnąć porady nauczyciela, podczas spotkania organizacyjnego. Zmiana trybu w trakcie/po ukończeniu kursu jest możliwa jedynie po konsultacji z nauczycielem i jest rozpatrywana indywidualnie.

3. Metoda

1. Usługobiorca/Uczeń akceptuje i zobowiązuje się do przestrzegania metody UP2 Academy oraz zaleceń nauczyciela, w celu osiągnięcia najlepszych rezultatów. Niestosowanie się do metody i/lub zaleceń nauczyciela może skutkować nieefektywnym postępem, za co Usługodawca nie ponosi odpowiedzialności.
2. Metoda UP2 Academy składa się z: lekcji online na żywo, ćwiczeń na platformie
   edukacyjnej oraz opcjonalnych lekcji dodatkowych online na żywo.
3. W trakcie lekcji online na żywo, Uczeń zapoznaje się i ćwiczy pod okiem nauczyciela materiał gramatyczno-leksykalny z danej części Rozdziału. Po odbytej lekcji, Uczeń loguje się na platformie edukacyjnej w celu kontynuowania nauki i wykonania ćwiczeń na słuchanie, czytanie, pisanie, a także zadań gramatyczno-leksykalnych oraz obejrzenia i rozwiązania zadań z części Real English. Po lekcji, Uczeń ma możliwość umówienia się na kolejną lekcję.
4. Po rozwiązaniu wszystkich zadań z odpowiednich części, Uczeń przystępuje do lekcji z kolejnego podrozdziału, po której kontynuuje praktykę na platformie edukacyjnej (patrz pkt. 3).
5. Podczas każdej lekcji, Uczeń demonstruje wiedzę i prezentuje umiejętności zdobyte podczas poprzednich lekcji oraz ćwiczeń na platformie edukacyjnej. W trakcie lekcji, nauczyciel ocenia zdolności językowe ucznia pod kątem użytych struktur gramatycznych, słownictwa, dokładności, płynności i ogólnej interakcji.
6. Proces nauki wygląda identycznie w kursach: General English, Business English oraz Exam Course. W przypadku kursu Speaking oraz Individual, proces zależy od oczekiwań i potrzeb Ucznia i jest on określany na zajęciach organizacyjnych i/lub na kilku pierwszych lekcjach.
7. Co kilka Rozdziałów, Uczeń wykonuje zadania powtórzeniowe oraz rozwiązuje test, który ma na celu weryfikację postępów w nauce i decyzję o kontynuacji do następnego podrozdziału lub Rozdziału. Natomiast jeżeli wyniki nie będą co najmniej dostateczne, to nauczyciel może zasugerować powtórzenie części materiału lub lekcję uzupełniającą.
8. Każde zajęcia oparte są na szczegółowych zasadach metody UP2 Academy, które cechuje:

a) komunikacyjność: nauka odbywa się poprzez rozmowę, odgrywanie ról oraz dyskusje, bez potrzeby wykuwania reguł na pamięć
b) immersja: lekcje oraz interakcja odbywają się w 100% w języku angielskim
c) praktyczność: lekcje oraz zadania osadzone są w konkretnym kontekście
d) indywidualne podejście: sposób prowadzenia lekcji jest dostosowany do poziomu oraz zainteresowań ucznia
e) rozwój umiejętności językowych: oprócz mówienia, ćwiczymy słuchanie, czytanie i pisanie, które są niezbędnymi elementami znajomości języka
f) autorskie materiały: lekcje online odbywają się w oparciu o specjalnie przygotowane materiały i zestawy interaktywnych ćwiczeń

4. Terminy lekcji, zmiany, odwołania

1. Usługodawca oferuje elastyczne terminy zajęć od poniedziałku do piątku, w dwóch blokach: porannym i popołudniowym. Blok poranny trwa od godziny 7:00 lub 8:00 do godziny 12:00, a blok popołudniowy trwa od godziny 15:00 lub 16:00 do godziny 22:00. Zajęcia w weekendy odbywają się w bloku porannym od godziny 8:00 do 12:00 lub 13:00.
2. Uczeń ma prawo wyboru godziny lekcji w jednym z dwóch bloków, uwzględniając rozpoczęcie o pełnej godzinie. Rezerwację terminu dokonuje się po każdej lekcji z nauczycielem, poprzez email, Whatsapp lub stronę internetową (UP2 Booking). Im wcześniejsza rezerwacja, tym większy wybór terminów. Możliwa jest rezerwacja lekcji maksymalnie na 14 dni do przodu (tylko w przypadku rezerwacji z nauczycielem, poprzez email bądź Whatsapp), licząc od dnia ubiegania się o rezerwację. Zajęcia nie odbywają się w czasie świąt i dni ustawowo wolnych od pracy.
3. Zmiany w rezerwacji lekcji są nielimitowane i można ich dokonać bezpłatnie w ramach wykupionego kursu/pakietu, ale nie później niż na 12 godzin przed planowym rozpoczęciem zajęć; poprzez rozmowę z nauczycielem po każdej lekcji lub kontaktując się z Usługodawcą za pośrednictwem emaila, Whatsappa bądź strony internetowej (UP2 Booking). Zmiana rezerwacji w czasie krótszym niż 12 godzin przed planowaną godziną zajęć (Late Cancel), jest rozumiana jako odwołanie zajęć (patrz pkt. 4). Każda zmiana wcześniej ustalonych terminów zajęć ma negatywny wpływ na proces nauki i dostępność nowych, bliższych terminów, w związku z czym Usługodawca przestrzega przed zbyt częstym i nieprzemyślanym dokonywaniu zmian.
4. Dokonanie rezerwacji poprzez stronę internetową (UP2 Booking) przy równoczesnym posiadaniu rezerwacji, skutkuje anulowaniem pierwotnego terminu lekcji oraz aktualizację o nową, wybraną przez ucznia datę. Szczegóły dotyczące nowego terminu lekcji dostępne będą w wiadomości email otrzymanej po dokonaniu rezerwacji.
5. Odwołanie zajęć, Late Cancel bądź niestawienie się o umówionej godzinie (No Show) skutkuje wyznaczeniem kolejnej lekcji z danego pakietu 1, 4 lub 8 lekcji. Usługodawca nie zwraca kosztów odwołanej lekcji. Uczniowi przysługuje prawo do odwołania zajęć bez konsekwencji opisanych w pkt. 3. tylko raz na wykupiony i aktywny pakiet zajęć (nie dotyczy No Show). Zaleca się odwoływanie lekcji tylko w wyjątkowych sytuacjach, aby nie miało to negatywnego skutku na proces nauki, jaki i dostępność wolnych terminów. W przypadku niemożliwości udziału w lekcjach przez okres dłuższy niż 14 dni, który spowodowany jest chorobą lub inną sytuacją losową niezależną od ucznia, Usługodawca zobowiązuje się do przedłużenia umowy o ilość dni określoną w zaświadczeniu lekarskim ucznia. Wszelkie inne przypadki będą rozpatrywane przez Usługodawcę indywidualnie.
6. Uczeń ma prawo do zmiany terminu lekcji tylko w okresie, w którym dany pakiet jest aktywny, tj. w ciągu 30 dni od daty pierwszej lekcji lub daty zaksięgowania płatności/przelewu.
7. Odwołanie zajęć przez nauczyciela na okres dłuższy niż 7 dni, powinno zostać zakomunikowane uczniowi ze stosownym wyprzedzeniem, od 14 do 30 dni z możliwością odrobienia zajęć w innym terminie, bez żadnych konsekwencji i z przedłużeniem ważności pakietu o ilość dni nieobecności nauczyciela.
8. Odwołanie zajęć przez nauczyciela na krócej niż 12 godzin przed umówionym terminem zajęć, powinno zostać zakomunikowane uczniowi niezwłocznie, z możliwością przełożenia umówionej lekcji na inny termin, bez konsekwencji opisanych w pkt. 4 oraz z zaproponowaniem bezpłatnej lekcji dodatkowej w ramach zadośćuczynienia.
9. Częste i nieuzasadnione zmiany i odwoływanie lekcji, tj. więcej niż 4 razy w ciągu trwania danego pakietu zajęć lub brak kontaktu z Uczniem przez okres dłuższy niż 7 dni, skutkuje natychmiastowym rozwiązaniem umowy pomiędzy Usługodawcą a Usługobiorcą, z uwzględnieniem zasad opisanych w §7 tego Regulaminu.
10. Wszelkie inne przypadki zmian terminów oraz odwoływania lekcji nieopisane w pkt. 1- 9, w tym zdarzenia losowe, będą rozpatrywane indywidualnie.

5. Zawieszenie aktywnego kursu/pakietu

1. Uczniowi przysługuje prawo do zawieszenia kursu na maksymalny okres do 30 dni, jeden raz na semestr, liczony od daty pierwszej lekcji lub daty zaksięgowania przelewu/płatności w danym semestrze.
2. Uczeń może zawiesić kurs/pakiet na okres krótszy niż 30 dni, nie mniej niewykorzystane dni nie sumują się, nie przechodzą na następny semestr i nie mogą być wykorzystane w innym terminie.
3. Uczeń jest zobowiązany poinformować Usługodawcę o chęci zawieszenia kursu z co najmniej 30-dniowym wyprzedzeniem.
4. Ważność niewykorzystanych lekcji lub samego pakietu, które zostały prawidłowo zawieszone, zostają przedłużone o liczbę dni wskazaną przez Ucznia, która maksymalnie może wynieść 30 dni oraz o liczbę dni pozostałych do końca pakietu sprzed daty rozpoczęcia zawieszenia kursu/pakietu.
5. Nauczyciel w porozumieniu z Uczniem ustalają termin zawieszenia oraz wznowienia kursu, jak i termin wykorzystania zaległych lekcji z danego pakietu.

6. Materiały dydaktyczne

1. Usługodawca zapewnia materiały dydaktyczne do nauki języka obcego, które są dostępne na platformie edukacyjnej oraz w trakcie lekcji w formie elektronicznej. Uczeń może, ale nie musi posiadać dodatkowych podręczników czy zestawów ćwiczeń. Usługodawca zaleca prowadzenie zeszytu do słówek i notatek, który pomoże w lepszym przyswojeniu materiału.

7. Platforma edukacyjna

1. Platforma edukacyjna jest integralną częścią metody UP2 Academy. Zapewnia ona dostęp do ćwiczeń na słuchanie, czytanie, pisanie, gramatykę, słownictwo oraz rozumienie potocznego języka (Real English). Oprócz tego, Uczeń ma możliwość monitorowania swojego postępu, sprawdzenia wyników i ocen lekcji.
2. Uczeń po dokonaniu wyboru kursu, otrzymuje email z instrukcją do samodzielnego utworzenia profilu oraz obsługi platformy https://www.edu.up2academy.com/. Dostęp do platformy jest możliwy 24 godziny na dobę, 7 dni w tygodniu. Usługodawca zobowiązuje się do nieprzerwanego i poprawnego dostępu do platformy. W razie jakichkolwiek nieprawidłowości, Uczeń powinien zgłosić swoje uwagi do nauczyciela po każdej lekcji lub bezpośrednio do Usługodawcy poprzez email albo Whatsapp.
3. Dostęp do platformy jest imienny i przysługuje tylko osobie, która wykupiła odpowiedni kurs i której pakiet zajęć jest aktywny.

8. Dyplomy i zaświadczenia

1. Uczeń po każdym ukończonym w 100% module może otrzymać na życzenie wyłącznie drogą mailową zaświadczenie o jego ukończeniu oraz z informacją o poziomie zaawansowania, na którym się znajduje.
2. Uczeń po ukończeniu każdego poziomu, może otrzymać na życzenie wyłącznie drogą mailową dyplom, który jest potwierdzeniem nabytego poziomu zaawansowania oraz umiejętności językowych w UP2 Academy.
3. Na życzenie ucznia, Usługodawca może wysłać fizyczną wersję dyplomu na wcześniej wskazany adres korespondencyjny.

§4 Zawarcie umowy

1. Sposób zawarcia umowy i test poziomujący

1. Zawarcie umowy pomiędzy Usługodawcą a Usługobiorcą oraz dostęp do Kursu następuje w momencie wprowadzenia danych karty kredytowej/debetowej i dokonania zakupu właściwego kursu lub wpłynięciu i zaksięgowaniu na rachunku bankowym Usługodawcy należnej kwoty.
2. W celu zawarcia umowy Usługobiorca powinien:
   a) Zapoznać się z ofertą kursów językowych prezentowaną na stronie internetowej
   UP2 Academy oraz niniejszym regulaminem;
   b) Kliknąć przycisk „Kup teraz” przypisany do właściwego kursu lub dokonać przelewu należnej kwoty na rachunek bankowy Usługodawcy;
   c) Zaakceptować niniejszy regulamin Usług świadczonych przez Szkołę Językową UP2 Academy;
   d) Dokonać zakupu wybranego kursu językowego lub pakietu lekcji poprzez wypełnienie i zaakceptowanie formularza płatności (dotyczy zakupu poprzez stronę internetową), co jest równoznaczne z realizacją punktu 2c powyżej.
3. Obowiązek zapłaty wskazany w ramach przycisku „Kup teraz” oznacza obowiązek dokonania przez Usługobiorcę na rzecz UP2 Academy zapłaty należności w celu zawarcia umowy o świadczenie usług przez UP2 Academy.
4. Po dokonaniu zakupu Uczeń otrzyma na podany przez siebie adres mailowy potwierdzenie zawarcia Umowy, która jest zawierana z chwilą zapłaty ceny, utrwalonej na trwałym nośniku. Usługobiorca akceptując niniejszy Regulamin wyraża zgodę na otrzymanie wyżej wymienionego potwierdzenia utrwalonego w inny sposób niż na papierze. Wyżej wskazana wiadomość e-mail zawiera potwierdzenie dotyczące rodzaju, poziomu oraz czasu trwania określonego kursu, potwierdzenie dokonania płatności oraz niniejszy regulamin.
5. Uczeń rozpoczynający naukę w UP2 Academy powinien wykonać bezpłatny test poziomujący online dostępny na stronie internetowej UP2 Academy w celu ustalenia właściwego poziomu kursu. Wyniki testu będą dostępne na platformie edukacyjnej.
6. Zarówno Umowa jak i obowiązek płatności zawierane są na czas nieokreślony do momentu jasnej deklaracji o jej zakończeniu w formie pisemnej przedłożonej przez Usługobiorcę bądź Usługodawcę, z zachowaniem okresu wypowiedzenia, wskazanym w §7 pkt. 1.

2. Pakiety i ceny

1. Lekcje indywidualne składają się z 3 Pakietów cenowych:
   UP2 x1 – 1 lekcja – cena podstawowa 75 PLN brutto;
   UP2 x4 – 4 lekcje – cena promocyjna 280 PLN brutto;
   UP2 x8 – 8 lekcji – cena promocyjna 520 PLN brutto.
2. Ceny wszystkich kursów oferowanych przez UP2 Academy są cenami brutto wyrażonymi w polskich złotych. Zamieszczone na stronie internetowej Szkoły Językowej UP2 Academy ceny kursów obejmują łączne wynagrodzenie UP2 Academy za świadczenie usług wraz z podatkami.
3. Wskazane wyżej w pkt 1 ppkt b i c ceny promocyjne obowiązują wyłącznie w
   przypadku wykupienia pakietu 4 lub 8 lekcji.
4. Usługobiorca zobowiązuje się do uiszczania opłaty w wysokości:
   a) 75 PLN i/lub iloczyn, w oparciu o liczbę zakupionych lekcji
   b) 280 i/lub 520 PLN lub ich iloczyn, w oparciu o liczbę zakupionych lekcji każdorazowo i niezwłocznie z góry najpóźniej w dniu pierwszej lekcji z danego pakietu lub w terminie wskazanym na fakturze.
5. Wszelkie opóźnienia w płatnościach będą rozpatrywane indywidualnie, w oparciu o obowiązujące prawo.
6. W przypadku pakietu 1 lekcji UP2 x1, przed rozpoczęciem danego kursu ustalana jest częstotliwość i/lub liczba lekcji w miesiącu oraz następuje opłata z góry za wskazaną liczbę lekcji. Wykupienie więcej niż jednej lekcji z pakietu UP2 x1 nie jest możliwa poprzez stronę internetową.
7. Ceny poszczególnych kursów określonych w §2 zależą od ilości wykupionych lekcji/rodzaju pakietu i występują w tylko następujących konfiguracjach:
   a) General English – pakiet 1/4/8 lekcji, odpowiednio 75/280/520 PLN lub ich iloczyn
   b) Business English – pakiet 1/4 lekcji, 75/280 PLN lub ich iloczyn
   c) Exam Course – pakiet 1 lekcji, 75 PLN lub ich iloczyn
   d) Speaking – pakiet 1/4/8 lekcji, odpowiednio 75/280/520 PLN lub ich iloczyn
   e) Individual – pakiet 1 lekcji, 75 PLN lub ich iloczyn
8. Płatność za dany pakiet w polskich złotych (PLN) dotyczy tylko dla obywateli Polski.
9. Pakiety 1/4/8 lekcji są ważne (aktywne) przez 30 dni od daty pierwszej lekcji z danego pakietu lub daty zaksięgowania płatności/przelewu. Niewykorzystane lekcje z danego pakietu w ciągu 30 dni od daty rozpoczęcia przepadają i nie są odrabiane lub zwracane.
10. Po upływie 30 dni od daty pierwszej lekcji lub zaksięgowania przelewu/płatności, Uczeń wykupuje kolejny pakiet, w celu kontynuacji nauki i dostępu do platformy edukacyjnej.
11. Po odbyciu ostatniej lekcji z danego pakietu i/lub upływie jego ważności, następuje okres przejściowy, który może ale nie musi trwać od 1 do maksymalnie 7 dni, w czasie którego Uczeń zobowiązany jest dokonać płatności za kolejny pakiet zajęć i dokonać rezerwacji terminu lekcji, w okresie nieprzekraczającym 7 dni od daty wygaśnięcia ostatniego pakietu.

§5 Formy płatności

1. Zapłata jest możliwa poprzez sklep internetowy https://shop.up2academy.com, który odpowiada za realizację płatności w UP2 Academy, a który oferuje następujące metody
   a) Płatność online realizowana przez bramkę płatności Paynow, zarządzaną przez AutoPay S.A, ul. Powstańców Warszawy 6, 81-718 Sopot, NIP: 5851351185, REGON: 191781561, KRS: 0000320590. Serwis AutoPay obsługuje karty: Visa, Visa Electron, MasterCard, Mastercard Electronic, Maestro.
   b) Płatność online poprzez platformę Stripe Payments Europe, Limited, 1 Grand Canal Street Lower, Dublin, D02 H210, Irlandia, zarejestrowaną pod nr 513174 i nadzorowaną przez Central Bank of Ireland.
   c) Płatność online poprzez platformę Google Pay obsługiwaną przez Google Payment Limited, 5 New Street Square, London, EC4A 3TW, Wielka Brytania, FCA nr 900008.
   d) Przelew bankowy – po uprzednim uzgodnieniu z Usługodawcą, na numer konta: (PLN) PL95 1140 2004 0000 3802 7972 1526; (EUR) ES91 2100 9723 6902 0054 5691.
2. W razie jakichkolwiek wątpliwości związanymi z założeniem konta i/lub dokonywania płatności za pośrednictwem powyższych serwisów, Usługobiorca ma możliwość zapoznania się z zasadami użytkowania, które są dostępne na stronach: https://autopay.pl/; https://stripe.com/; https://pay.google.com/.
3. Uczeń jest zobowiązany do terminowych płatności za pakiety zajęć, zgodnie z datą wskazaną na fakturze.
4. Za wszelkie opóźnienia w płatnościach mogą zostać naliczone odsetki karne, zgodnie z obowiązującym prawem.

§6 Prawo do odstąpienia od umowy

1. Zgodnie z Artykuł 102 Królewskiego Dekretu Ustawodawczego 1/2007 konsument zawierając „umowę na odległość” – jest uprawniony do odstąpienia od umowy bez podania przyczyny i bez ponoszenia kosztów – w terminie 14 dni kalendarzowych od podpisania Umowy. W takim przypadku, Usługobiorca zobowiązuje się niezwłocznie poinformować Usługodawcę o tym fakcie mailowo, stosując wzór wypowiedzenia umowy, który znajduje się w mailu powitalnym.
2. W przypadku odstąpienia od Umowy uważa się ją za niezawartą.
3. Usługodawca w terminie 14 dni od dnia otrzymania oświadczenia konsumenta o odstąpieniu od Umowy, zwróci dokonane przez niego płatności przy użyciu takiego samego sposobu zapłaty, jakim posłużył się Usługobiorca, chyba że wyraźnie zgodzi się on na inny sposób zwrotu, który nie wiąże się dla niego z żadnymi kosztami.
4. W sytuacji, gdy Konsument wyraźnie zażądał, by Usługodawca rozpoczął świadczenie usług przed upływem terminu do odstąpienia od Umowy, Konsument zobowiązany jest do zapłaty za świadczenie spełnione do chwili odstąpienia od Umowy. Przedmiotowa kwota zostanie potrącona z ceny zwracanej Usługobiorcy za kurs.

§7 Rezygnacja z usług UP2 Academy

1. Wypowiedzenie umowy o świadczenie usług po upływie 14 dni od daty zawarcia umowy, powinno się odbyć z zachowaniem 30 dniowego okresu wypowiedzenia, liczonego od dnia przedłożenia pisemnej rezygnacji z kursu/pakietu.
2. W przypadku rezygnacji przez Usługobiorcę z aktywnego pakietu lekcji indywidualnych po upływie 14 dni od dnia zawarcia Umowy lub bez zachowania okresu wypowiedzenia określonego w pkt. 1, tj. ze skutkiem natychmiastowym, Usługobiorca zobowiązany jest do zapłaty opłaty wyrównującej, która stanowi różnicę ceny podstawowej i ceny promocyjnej pomnożonej przez ilość lekcji z danego pakietu.
3. W czasie trwania okresu wypowiedzenia, Uczeń ma wszelkie prawa wynikające z posiadania aktywnego kursu/pakietu oraz prawo do wykorzystania w całości pakietu lekcji, do końca trwania okresu wypowiedzenia bądź okresu aktywności pakietu zajęć.
4. Kurs/pakiet zajęć przestaje być aktywny w momencie upływu terminu ważności ostatniego pakietu zajęć i/lub w momencie upływu 30-dniowego okresu wypowiedzenia.
5. W przypadku przerw w dostawie Usług, spowodowanych przerwami technicznymi, niewynikającymi z winy ucznia, Usługodawca zobowiązuje się zrekompensować niedogodności, oferując co najmniej jedną, dodatkową, bezpłatną lekcję indywidualną, którą Uczeń może wykorzystać w dowolnym terminie podczas trwania umowy.
6. Wszelkie zwroty następują zgodnie z zastosowaniem pkt. 2 oraz 3 tego paragrafu, na rachunek bankowy przypisany do karty lub wskazany przez Ucznia. W innych przypadkach zwrot środków pieniężnych nie jest możliwy.
7. W przypadku braku kontaktu z Uczniem przez okres przez okres dłuższy niż 7 dni, skutkuje natychmiastowym rozwiązaniem umowy pomiędzy Usługodawcą a Usługobiorcą, z uwzględnieniem zasad opisanych w pkt. 1-4 tego paragrafu.
8. Wznowienie zajęć w sytuacji opisanej w pkt. 7. skutkuje zawarciem nowej umowy, na bieżących zasadach obowiązujących w danym momencie.
9. Wszelkie inne przypadki nieopisane w pkt. 1-8, będą rozpatrywane indywidualnie.

§8 Reklamacje

1. Usługobiorcy przysługuje uprawnienie do złożenia reklamacji dotyczącej świadczonych przez UP2 Academy usług.
2. Reklamacje należy składać za pośrednictwem poczty elektronicznej na adres e-mail kontakt@up2academy.com lub w formie pisemnej bezpośrednio w siedzibie UP2 Academy, Calle Oviedo 121/2D, 50007 Saragossa, Hiszpania lub Skrzynice Pierwsze 101, 23-114 Jabłonna.
3. Reklamacja powinna zawierać: dane kontaktowe Usługobiorcy (imię, nazwisko, adres poczty elektronicznej) oraz opis problemu będącego podstawą złożenia reklamacji.
4. UP2 Academy w terminie 14 dni od dnia zgłoszenia reklamacji przez Usługobiorcę rozpatrzy reklamację. Brak odpowiedzi Usługodawcy w tym terminie poczytuje się za rozpatrzoną zgodnie z wolą Usługobiorcy.

§9 Pozasądowe rozwiązywanie sporów

1. Wykonując obowiązek wskazania pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń oraz zasad dostępu do tych procedur Usługodawca informuje, że Konsumenci i przedsiębiorcy mogą wykorzystać do polubownego rozstrzygania sporów powołaną przez Komisję Europejską internetową platformę ODR. Platforma jest dostępna pod adresem:https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.sho w&lng=PL. UOKIK prowadzi rejestr podmiotów uprawnionych do pozasądowego rozwiązywania sporów konsumenckich  pod adresem https://polubowne.uokik.gov.pl/.

§10 Polityka prywatności

1. Administratorem danych osobowych Usługobiorców będących osobami fizycznymi jest Usługodawca, tj. Przemysław Wajrak prowadzący działalność gospodarczą pod firmą UP2 Academy Przemysław Wajrak, który w pełni respektuje prawo do prywatności i ochrony danych osobowych Usługobiorców, stosownie do przepisów zgodnych z postanowieniami Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. (RODO) oraz hiszpańskiej ustawy organicznej 3/2018 z dnia 5 grudnia 2018 r. o ochronie danych osobowych oraz gwarancji praw cyfrowych (Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales), dane osobowe będą przetwarzane w sposób zgodny z prawem, rzetelny i przejrzysty, wyłącznie w celach, dla których zostały zebrane, i z poszanowaniem praw osoby, której dane dotyczą).
2. Administrator danych osobowych przetwarza następujące dane osobowe Usługobiorcy: imię i nazwisko, adres do korespondencji, adres poczty elektronicznej (adres e-mail), numer telefonu. W przypadku Usługobiorców/Uczniów, którzy życzą sobie wystawienia faktury Administrator przetwarza również dalsze dane niezbędne do wystawienia faktury VAT, tj. nazwa nabywcy, adres, NIP.
3. Podanie powyższych danych jest dobrowolne, ale niezbędne do złożenia Zamówienia i zawarcia Umowy o świadczenie usług.
4. Podstawą prawną przetwarzania danych osobowych jest art. 6 ust. 1 pkt b) RODO – przetwarzanie jest niezbędne do wykonania umowy o świadczenie usług, której Usługobiorca jest stroną lub do podjęcia na żądanie Usługobiorcy działań przed zawarciem umowy.
5. Administrator danych osobowych gwarantuje Usługobiorcy realizację uprawnień wynikających z obowiązujących przepisów o ochronie danych osobowych, w ramach których Usługobiorca ma prawo dostępu do treści swoich danych, ich sprostowania, usunięcia (prawo do bycia zapomnianym), ograniczenia przetwarzania, prawo do przenoszenia danych, prawo do wniesienia sprzeciwu wobec przetwarzania danych
6. Dane osobowe Usługobiorcy będą podlegały udostępnieniu podmiotom trzecim jedynie w zakresie realizacji umowy o świadczenie usług. Odbiorcami danych osobowych Usługobiorcy mogą być firmy obsługujące płatności internetowe oraz podmioty zajmujące się obsługą informatyczną administratora danych.
7. Dane osobowe Usługobiorcy będą przechowywane przez okres 10 lat lub do ewentualnego żądania ich usunięcia przez Usługobiorcę.
8. W przypadku uznania, iż przetwarzanie danych osobowych narusza przepisy unijnego rozporządzenia RODO, Usługobiorcy przysługuje prawo wniesienia skargi do Organu Nadzorczego (Prezesa Urzędu Ochrony Danych Osobowych).
9. Usługobiorca zgadza się na otrzymywanie niezbędnych powiadomień dotyczących zajęć lub spraw organizacyjnych drogą mailową bądź poprzez komunikatory i aplikacje temu służące.

§11 Prawa autorskie

1. Wszelkie materiały edukacyjne dostępne na stronach i platformie edukacyjnej w domenie up2academy.com podlegają ochronie na podstawie Ustawy o prawie autorskim i prawach pokrewnych (Dz. U. z 2018 r., poz. 880) oraz Królewskiego Dekretu Ustawodawczego 1/1996 z dnia 12 kwietnia.
2. Materiały te mogą być wykorzystywane wyłącznie przez osoby, które dokonały ich zakupu lub wykupiły Pakiet lekcji. Uczeń ma prawo drukować i korzystać z tych materiałów wyłącznie w celach edukacyjnych i tylko na użytek własny.
3. W przypadku chęci wykorzystania któregokolwiek z elementów serwisów UP2 Academy w celach innych niż edukacyjny i na własny użytek, Uczeń zobowiązany jest do wystosowania pisemnej prośby do Usługodawcy o pozwolenie na wykorzystanie danych materiałów.
4. Usługodawca zastrzega sobie prawo do modyfikacji i ulepszania treści Kursu w trakcie jego trwania.

English version (EN)

§1 Definitions

a) UP2 Academy Language School – a language school owned by the service providor.

b) Service Provider – the owner of UP2 Academy Language School, Przemysław Wajrak conducting business under the name UP2 Academy Przemysław Wajrak, Tax ID: Z0843143Z.

c) Service Recipient/Student – an individual entitled to participate in the Course a) who has full legal capacity or b) who is 16 years of age or older and has limited legal capacity, provided that the prior consent of his/her legal representative has been obtained for his/her participation in the Course and conclusion of an agreement in this regard.

d) Consumer – a natural person of full legal capacity purchasing a service not directly related to his/her business or professional activity.

e) Service – teaching a foreign language using the UP2 method, teacher-led lessons and follow- up lessons, as well as access to the educational platform.

f) Course/package – a type of Service offered by UP2 Academy. Refers to one-on-one lessons that consist of: 60-minute live online lessons, access to the learning platform in one of 5 modes: General English, Business English, Exam Course, Speaking, Individual.

g) Method – the way in which learning a foreign language at UP2 Academy takes place and which is optimal in terms of efficiency and which should be followed by the student.

h) Package – set of 1, 4 or 8 individual lessons.

i) Chapter – a unit of division of the course, which consists of a minimum of 3 subchapters.

j) Educational Platform – the UP2 Academy Language School website located at https://edu.up2academy.com/, which includes exercises for each Module and the Student’s activity log.

k) Semester – a period of 6 months, calculated from the date of the first lesson or posting of payment/transfer.

l) Month – a period of 30 days, counted from the date of the first lesson in a given package to its end.

m) Transition Period – a period valid from the end of a given package to the beginning of the next one, which may range from a minimum of one to seven (7) days, counting from the date of the last lesson of a given package and/or from the date of expiry of the package.

n) No Show – a term describing failure to show up at the scheduled lesson time without prior information about its cancellation, which is equivalent to considering the lesson as done.

o) Late Cancel – a term describing the cancellation or rescheduling of a scheduled lesson in less than 12 hours from its start time.

p) UP2 Booking – website enabling independent booking of class dates, as well as viewing the availability of dates, located at: https://booking.up2academy.com.

q) Quotient – an indicator determining the number of lessons multiplied by the standard price.

r) Durable Medium – an electronic message sent to the Client’s electronic address provided during the Order, allowing the Service Provider to provide the Client with information on the Order, which can be reproduced in the future in an unaltered form.

s) Order – a statement of the Customer made through the UP2 Academy Language School website located at https://www.up2academy.com/, expressing the will to conclude a contract for the provision of educational services.

t) Agreement – an agreement for the provision of services within the meaning of the provisions of the article 1254 of Spanish Civil Law Code, concluded by the Service Provider with the Service Recipient using means of remote communication, including e-mails and forms available on the website of UP2 Academy Language School.

u) UP2 Shop – an online shopping platform that offers UP2 Academy language courses and enables online payments via bank transfer, Blik, credit cards and GPay.

§2 General provisions

1. The owner of the UP2 Academy language school is Przemyslaw Wajrak who conducts business activity under the name UP2 Academy with its registered office: Calle Oviedo 121/2D, 50007 Zaragoza; Tax ID: Z0843143Z mailing address in Poland: Skrzynice Pierwsze 101, 23-114 Jablonna; NIP: 7133006732, REGON: 385494334; telephone: +48 883 119 228, e-mail: p.wajrak@up2academy.com
2. Before using the Services offered by UP2 Academy, you must read all provisions of these Terms and Conditions, which can be downloaded, saved and printed. Use of the Services offered by UP2 Academy implies acceptance of these Regulations and the Privacy Policy. The condition for placing an order (concluding an agreement) is prior confirmation of reading the content of the Regulations.
3. These Regulations were issued, among other things, pursuant to Article 2 LSSI-CE (Ley 34/2002) and Real Decreto Legislativo 1/2007, in particular Article 103–107 (with amendment Ley 3/2014) of Spanish Civil Law Code.
4. These Terms and Conditions contain the terms and conditions for entering into Contracts for the sale of UP2 Academy Services. The Service Provider reserves the right to change prices of the Services it offers, introduce new Services to its offer, conduct, cancel or introduce changes to promotional actions on the Service Provider’s website located at https://up2academy.com/. The right referred to in the first sentence does not affect the effectiveness, execution and price of previously placed orders and promotional actions. The Service Provider shall inform the Client by e-mail about the changes indicated in the first sentence above. A Client who does not accept the terms and conditions as amended is entitled to withdraw from the contract within 14 days of receiving an e-mail containing the amended terms and conditions, either by e-mail or via Whatsapp. If the Client withdraws from the contract, the contract expires on the date of receipt of the relevant statement.
5. The recipient is obliged not to take any action that may adversely affect the proper functioning of the UP2 Academy website, including the provision of unlawful

§3 Terms and conditions of the services provided by UP2 Academy

1. Technical requirements

1. In order to properly use the UP2 Academy Services, you will need:
   a) Desktop/laptop/mobile device;
   b) Internet access – minimum speed – 500 kbps;
   c) Web browser – recommended latest version: Chrome, Mozilla, Firefox, Microsoft Edge and Safari (version 7 or higher), Internet Explorer (version 10 or higher);
   d) Webcam;
   e) Microphone and speakers or headphones;
   f) Appropriate software to participate in the lesson – Skype with an active account and to contact the Service Provider – Whatsapp;
   g) Active email account (Gmail recommended)
2. All technical requirements should be verified by the Client/Student before purchasing the Service, as the Service Provider is not responsible for malfunctioning of hardware or software on the part of the Client/Student.

2. Types of courses and services provided by the Service Provider

UP2 Academy Language School offers the following types of courses:

1. Individual lessons – fully personalized lessons in a 1/4/8 lesson
2. The Service Provider, as part of the course specified in In addition, it provides Students with:
   a) unlimited access to the educational platform 24 hours a day, 7 days a week;
   b) teacher supervision and monitoring of the student’s progress (including through the educational platform);
   c) additional remedial lessons, offered on the teacher’s recommendation, aimed at clarifying doubts, practicing a specific issue and better preparing for the next lesson within the purchased package of lessons;
   d) The opportunity to take a free test to check the level of proficiency of the Student;
   e) flexible schedule and the ability to book lessons at almost any time (including weekends for a 1 lesson package);
   f) teaching materials included;g) cancellation or rescheduling of classes – see 3 point IV for more details
3. Individual lessons are held in one of 5 modes:
   a) General English: learning general English at levels from basic (A1, A2, A2+), through intermediate (B1, B1+, B2, B2+) to advanced (C1, C1+, C2);
   b) Business English: business English from basic to advanced;
   c) Exam Course: an examination course for candidates wishing to pass one of the Cambridge language exams: Preliminary (B1), First (B2), Advanced (C1), Proficiency (C2) and for students taking the matriculation exam (basic and extended);
   d) Speaking: classes with an emphasis on speaking: improving pronunciation, learning speaking fluency techniques, eliminating the most common lexical and grammatical errors, gaining confidence, preparing for job interviews and self- presentation;
   e) Individual: fully personalized and tailored classes that go beyond the scope of the above courses (tutoring of current material from school or college, industry-specific language, methodological assistance for TKT, CELTA, Delta courses)
4. The student should choose the appropriate mode before the start of the course, and if in doubt, should consult the teacher, during the organizational meeting. Changing the mode during/after the course is possible only after consultation with the teacher and is considered on a case-by-case basis.

3. Method

1. The Service Recipient/student accepts and agrees to follow the UP2 Academy method and the teacher’s recommendations in order to achieve the best results. Failure to follow the method and/or the teacher’s recommendations may result in ineffective progress, for which the Service Provider is not responsible.
2. The UP2 Academy method consists of: live online lessons, learning platform exercises, and optional live online supplementary lessons.
3. During the live online lesson, the Student learns and practices the grammar and lexical material from the given part of the Chapter under the guidance of the teacher. After the lesson, the Student logs on to the educational platform to continue learning and doing exercises for listening, reading, writing, as well as grammar and lexical tasks, and to view and solve tasks from the Real English After the lesson, the Student has the opportunity to make an appointment for the next lesson.
4. After solving all the tasks of the relevant sections, the Student enters the lesson of the next subsection, after which he continues to practice on the educational platform (see point 3).
5. During each lesson, the learner demonstrates knowledge and displays skills acquired during previous lessons and exercises on the learning During the lesson, the teacher evaluates the Student’s language skills in terms of grammatical structures used, vocabulary, accuracy, fluency and overall interaction.
6. The learning process looks identical in the courses: General English, Business English and Exam In the case of Speaking and Individual courses, the process depends on the expectations and needs of the student and is determined during the organizational classes and/or the first few lessons.
7. Every few Chapters, the Student performs repetition tasks and solves a test to verify progress and decide whether to continue to the next subchapter or Chapter. On the other hand, if the results are not at least sufficient, the teacher may suggest repeating part of the material or a follow-up lesson.
8. Each class is based on the detailed principles of the UP2 Academy method, which features:
   a) communicative: learning takes place through conversation, role-play and discussion, without the need to forge rules by heart;
   b) immersion: lessons and interaction are 100% in English;
   c) practicality: lessons and tasks are set in a concrete context;
   d) individual approach: the way lessons are conducted is adapted to the level and interests of the student;
   e) development of language skills: in addition to speaking, we practice listening, reading and writing, which are essential elements of language proficiency;
   f) original materials: online lessons are based on specially prepared materials and sets of interactive exercises

4. Lesson dates, changes, cancellations

1. The service provider offers flexible class times from Monday to Friday, in two blocks: a morning block and an afternoon block. The morning block runs from 7:00 or 8 a.m. to 12:00 p.m., and the afternoon block runs from 3:00 or 4 p.m. to 10:00 p.m. Weekend classes are held in the morning block from 8:00 a.m. to 12:00 or 1:00 p.m.
2. The student has the right to choose the time of the lesson in one of two blocks, taking into account the start at the full hour. Reservation of the date is made after each lesson with the teacher, via email, Whatsapp or the booking website (UP2 Booking). The earlier the reservation, the greater the choice of dates. It is possible to book lessons up to 14 days in advance (only in case of reservation with the teacher or via email or Whatsapp), counting from the day of applying for a reservation. Lessons are not held during holidays and public holidays.
3. Changes in lesson reservations are unlimited and can be made free of charge within the purchased course/package, but no later than 12 hours before the scheduled start of classes; by talking to the teacher after each lesson, by contacting the Service Provider via email, Whatsapp or via the booking website (UP2 Booking). Change of booking within less than 12 hours before the scheduled class time (Late Cancel), it is understood as cancellation of the class (see point 4). Any change of pre-scheduled class times has a negative impact on the learning process and the availability of new, closer dates, and therefore the Service Provider cautions against making changes too frequently and recklessly.
4. Making a reservation via the website (UP2 Booking) and having a reservation at the same time results in the cancellation of the original lesson date and an update with a new date selected by the Details about the new lesson date will be available in an email received after the booking.
5. Cancellation of the lesson or failure to appear at the agreed time (No Show) will result in appointment of another lesson from the given package of 1, 4 or 8 lessons. The Service Provider will not refund the cost of the cancelled lesson. The Student has the right to cancel lessons without the consequences described in paragraph only once per purchased and active lesson package (except for No Show). It is recommended to cancel lessons only in exceptional situations, so that it does not have a negative effect on the learning process, as well as on the availability of free time. In case of inability to participate in lessons for more than 14 days, which is caused by illness or other fortuitous situation beyond the control of the student, the Service Provider undertakes to extend the contract by the number of days specified in the student’s medical certificate. All other cases will be considered by the Service Provider on a case-by-case basis.
6. The student has the right to reschedule the lesson only during the period in which the package is active, i.e. within 30 days from the date of the first lesson or the date of posting of payment/transfer.
7. Cancellation of classes by the teacher for a period of more than 7 days, should be communicated to the student well in advance, from 14 to 30 days with the possibility of making up classes at another time, without any consequences and with the extension of the package by the number of days of absence of the teacher.
8. Cancellation of classes by the teacher less than 12 hours before the agreed lesson date should be communicated to the student immediately, with the possibility of postponing the agreed lesson to another date, without the consequences described in paragraph. 4 and with the offer of a free additional lesson as compensation.
9. Frequent and unjustified changes and cancellation of lessons, i.e. more than 4 times during the course of a given package of lessons or lack of contact with the Student for more than 7 days, will result in immediate termination of the contract between the Service Provider and the Customer, subject to the rules described in §7 of these Regulations.
10. Any other cases of rescheduling and cancellation of lessons not described in para. 1- 9, including fortuitous events, will be considered on a case-by-case basis.

5. Suspension of active course/package

1. The student has the right to suspend the course for a maximum period of up to 30 days, once per semester, calculated from the date of the first lesson or the date of posting of the transfer/payment for the semester.
2. A student may suspend a course/package for less than 30 days, no less unused days do not add up, do not carry over to the next semester and cannot be used at another date.
3. The student is obliged to inform the Service Provider of his/her desire to suspend the course at least 30 days in advance.
4. The validity of unused lessons or the package itself, which have been properly suspended, shall be extended by the number of days indicated by the Student, which may be up to a maximum of 30 days, and by the number of days remaining in the package before the start date of the course/package suspension.
5. The teacher, in consultation with the student, will determine the date of suspension and resumption of the course, as well as the date for the use of outstanding lessons from the package.

6. Teaching materials

1. The service provider provides teaching materials for learning a foreign language, which are available on the educational platform and during the lesson in electronic The student may or may not have additional textbooks or exercise sets. The service provider recommends keeping a notebook for vocabulary and notes, which will help to better assimilate the material.

7. Educational platform

1. The learning platform is an integral part of the UP2 Academy method. It provides access to exercises for listening, reading, writing, grammar, vocabulary and understanding colloquial language (Real English). In addition, the Student has the opportunity to monitor his progress, check the results and evaluate the lessons.
2. The student, after selecting a course, receives an email with instructions for self- creation of the profile and operation of the platform https://www.edu.up2academy.com/. The platform can be accessed 24 hours a day, 7 days a week. The Service Provider is committed to uninterrupted and correct access to the platform. In case of any irregularities, the Student should report his/her comments to the teacher after each lesson or directly to the Service Provider via email or Whatsapp.
3. Access to the platform is personal and is only granted to a person who has purchased the corresponding course and whose class package is active.

8. Diplomas and certificates

1. The student, after each module that is 100% completed, can receive, upon request only by email, a certificate of completion and with information on the level at which he or she is.
2. Upon completion of each level, a student can receive a diploma upon request by email only, which is a confirmation of the acquired level of proficiency and language skills at UP2 Academy.
3. At the request of the student, the Service Provider may send a physical version of the diploma to the previously indicated mailing address.

§4 Conclusion of contract

1. The way of concluding the contract and the levelling test

1. The conclusion of the contract between the Service Provider and the Client and access to the Course takes place when the credit/debit card details are entered and the purchase of the relevant Course is made or the amount due is received and credited to the Service Provider’s bank account.
2. In order to conclude a contract, the Service Recipient should:
   a)Become familiar with the language course offerings presented on the UP2 Academy website and these terms and conditions;
   b) Click the “Buy Now” button assigned to the appropriate course or transfer the amount due to the Service Provider’s bank account;
   c) Accept these terms and conditions of the Services provided by UP2 Academy Language School;
   d) Make a purchase of the selected language course or lesson package by completing and accepting the payment form (applies to purchase through the website), which is equal to implementation of point 2c above.
3. The obligation to pay indicated under the “Buy Now” button means the obligation of the Customer to make payment to UP2 Academy in order to conclude a contract for the provision of services by UP2 Academy.
4. After making a purchase, the Student will receive a confirmation of the Agreement, which is concluded upon payment of the price, recorded on a durable medium, to the email address provided by the Student. The Service Recipient, by accepting these Regulations, agrees to receive the aforementioned confirmation fixed in a manner other than on paper. The aforementioned e-mail message contains confirmation regarding the type, level and duration of the specified course, confirmation of payment and these Regulations.
5. A student entering UP2 Academy should take a free online levelling test available on the UP2 Academy website to determine the appropriate course level. The results of the test will be available on the educational platform.
6. Both the contract and the payment obligation are concluded for an indefinite period of time until a clear declaration of termination in writing submitted by either the Service Recipient or the Service Provider, subject to the notice period indicated in §7 item 1.

2. Packages and prices

1. Individual lessons consist of 3 Price Packages:
   UP2 x1 – 1 lesson – basic price 20 EUR gross;
   UP2 x4 – 4 lessons – promotional price 70 EUR gross;
   UP2 x8 – 8 lessons – promotional price 120 EUR gross
2. The prices of all courses offered by UP2 Academy are gross prices expressed in euros (EUR). The course prices posted on the UP2 Academy Language School website include UP2 Academy’s total remuneration for the provision of services including taxes.
3. The promotional prices indicated above in point 1(b) and (c) are valid only if you purchase a package of 4 or 8 lessons.
4. The Client agrees to pay the fee of:
   a) 20 EUR and/or the quotient of selected number of lessons;
   b) 70 EUR / 120 EUR and/or their quotient of selected number each time and immediately in advance, no later than on the day of the first lesson of a given package or on the date indicated on the invoice.
5. Any late payment will be considered on a case-by-case basis, based on applicable law.
6. In the case of the package of 1 lesson UP2 x1, before starting the course a set number and/or frequency of lessons per month is specified followed by a payment in advance, for given number of lessons. Purchasing more than one lesson during one transaction is not possible vie the website.
7. Prices of individual courses specified in 2 depend on the number of lessons purchased / type of Package and occur in only the following configurations:
   a) General English – package of 1/4/8 lessons, 20/70/120 EUR or their quotient;
   b) Business English – package of 1/4 lessons, 20/70 EUR or their quotient;
   c) Exam Course – package of 1 lesson, 20 EUR or their quotient;
   d) Speaking – package of 1/4/8 lessons, 20/70/120 EUR or their quotient;
   e) Individual – package of 1 lesson, 20 EUR or their quotient
8. Payment for the given package in Euros (EUR) applies to all non-Polish citizens.
9. The 1/4/8 lesson packages are valid (active) for 30 days from the date of the first lesson of the package or the date of posting of payment/transfer. Unused lessons from a given package within 30 days of the start date are forfeited and are not made up or redunded.
10. After the expiration of 30 days from the date of the first lesson or the posting of the transfer/payment, the Student purchases another package to continue learning and access to the educational platform.
11. After completing the last lesson of a given package and/or its validity expires, there is a transition period, which may or may not last from 1 to a maximum of 7 days, during which the Student is obliged to make a payment for the next package of classes and book a lesson date, within a period not exceeding 7 days from the date of expiry of the last package.

§5 Forms of payment

1. Payment is possible through the online store https://shop.up2academy.com, which is responsible for processing payments at UP2 Academy, and which offers the following methods:
   a) Online payment via the AutoPay S.A. payment system, Powstańców Warszawy 6, 81-718 Sopot, NIP: 5851351185, REGON: 191781561, KRS: 0000320590. The AutoPay service supports the following cards: Visa, Visa Electron, MasterCard, Mastercard Electronic, Maestro.
   b) Online payment via the Stripe Payments Europe, Limited platform, 1 Grand Canal Street Lower, Dublin, D02 H210, Ireland, registered under number 513174 and supervised by the Central Bank of Ireland.
   c) Online payment via the Google Pay platform operated by Google Payment Limited, 5 New Street Square, London, EC4A 3TW, United Kingdom, FCA number 900008.
   d) Bank transfer – by prior arrangement with the Service Provider, to the account number: (PLN) PL95 1140 2004 0000 3802 7972 1526; (EUR) ES91 2100 9723 6902 0054 5691.

3. In case of any payment problems, the Customer shall immediately notify the Service Provider by email: contact@up2academy.com.
4. The student is obliged to make timely payments for class packages, in accordance with the date indicated on the invoice.
5. Penalty interest may be charged for any late payment in accordance with applicable law.

§6 Right to withdraw from the contract

1. In accordance with Article 102 of Royal Legislative Decree 1/2007, a consumer concluding a “remote contract” – is entitled to withdraw from the contract without giving any reason and without incurring any costs – within 14 calendar days from signing the In this case, the Client agrees to immediately inform the Service Provider by e-mail, using the template for termination of the Agreement, which is included in the welcome e-mail.

The amount in question will be deducted from the price returned to the Consumer for the course.

§7 Cancellation of UP2 Academy services

1. Termination of the service contract after 14 days from the date of conclusion of the contract, should be given 30 days’ notice from the date of submission of written cancellation of the course/package.
2. If the Customer cancels the active package of individual lessons after 14 days from the date of conclusion of the Agreement or without observing the notice period specified in item. 1, i.e. with immediate effect, the Service Recipient is obliged to pay a compensation fee, which is the difference of the basic price and the promotional price multiplied by the number of lessons of the given package.
3. During the termination period, the Student has all rights under the active course/package and the right to use the lesson package in full, until the end of the termination period or the activity period of the lesson package.
4. The course/class package ceases to be active upon expiration of the last class package and/or upon expiration of the 30-day notice period.
5. In case of interruption of the Services due to technical interruptions, not attributable to the Student, the Service Provider agrees to compensate for the inconvenience by offering at least one additional free individual lesson, which the Student may use at any time during the term of the contract.
6. All refunds are made in accordance with point 2 and 3 of this paragraph, to the bank account assigned to the card or indicated by the Student. In other cases, refunds are not possible.
7. In the event of lack of contact with the Student for a period longer than 7 days, this results in immediate termination of the contract between the Service Provider and the Service Recipient, taking into account the rules described in point 1-4 of these

9. Any other cases not described in 1-8, will be considered on a case-by-case basis.

§8 Complaints

1. The customer has the right to file a complaint regarding the services provided by UP2 Academy.
2. Complaints should be submitted via e-mail to contact@up2academy.com or in writing directly to the UP2 Academy, Calle Oviedo 121/2D, 50007 Zaragoza, Spain or Skrzynice Pierwsze 101, 23-114 Jablonna, Poland.
3. The complaint should include: contact details of the Customer (name, surname, e- mail address) and a description of the problem giving rise to the complaint.
4. UP2 Academy will consider the complaint within 14 days from the date of submission of the complaint by the Customer. Failure of the Service Provider to respond within this period shall be considered as considered in accordance with the will of the Service

§9 Out-of-court dispute resolution

1. 1. The administrator of the personal data of the Service Recipients who are natural persons is the Service Provider, i.e. Przemysław Wajrak who conducts business under the name UP2 Academy Przemysław Wajrak, which fully respects the right to privacy and protection of personal data of the Service Recipients, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR) and the Spanish Organic Law 3/2018 of 5 December 2018 on the Protection of Personal Data and the Guarantee of Digital Rights (Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales), personal data will be processed lawfully, fairly and transparently, solely for the purposes for which they were collected and in compliance with the rights of the data subject.

3. Provision of the above data is voluntary, but necessary to place an Order and conclude a Service Agreement.
4. The legal basis for the processing of personal data is Article 6(1)(b) – processing is necessary for the performance of a contract for the provision of services to which the Customer is a party or to take action at the request of the Customer prior to entering into a contract.
5. The Administrator of personal data guarantees to the Service Recipient the exercise of rights under applicable data protection laws, under which the Service Recipient has the right to access the content of his data, rectification, deletion (right to be forgotten), restriction of processing, right to data portability, right to object to the processing of personal data.
6. The Customer’s personal data will be subject to sharing with third parties only to the extent of performance of the contract for services. Recipients of the Service Recipient’s personal data may be companies that process online payments and entities that provide IT support to the data controller.
7. The Service Recipient’s personal data will be retained for a period of 10 years or until any request for deletion by the Service Recipient.
8. If the processing of personal data is deemed to violate the provisions of the EU Regulation, the Service Recipient has the right to lodge a complaint with the Supervisory Authority (President of the Office for Personal Data Protection).
9. The service recipient agrees to receive necessary notifications regarding classes or organizational matters by e-mail or via instant messengers and applications.

§11 Copyright

1. All educational materials available on websites and educational platform in up2academy.com domain are protected under the Copyright and Related Rights Act (Journal of Laws of 2018, item 880) and Royal Legislative Decree 1/1996, of April 12, approving the revised text of the Intellectual Property Law.
2. These materials may only be used by those who have purchased them or the Packages. The student has the right to print and use these materials only for educational purposes and only for personal use.
3. If the Student wishes to use any of the UP2 Academy websites elements for purposes other than educational and personal use, the Student must make a written request to the Service Provider for permission to use the materials in question.
4. The Service Provider reserves the right to modify and improve the content of the Course during the course of the Course.

e) Servicio – enseñanza de una lengua extranjera utilizando el método UP2, lecciones dirigidas por el profesor y lecciones de seguimiento, así como acceso a la plataforma de aprendizaje.

f) Curso/paquete – un tipo de Servicio ofrecido por UP2 Academy. Se refiere a lecciones individuales que consisten en: Lecciones online en directo de 60 minutos, acceso a la plataforma de aprendizaje en una de las 5 modalidades: General English, Business English, Exam Course, Speaking, Individual.

g) Método – la forma en que se lleva a cabo el aprendizaje de lenguas extranjeras en UP2 Academy y que es óptima en términos de eficacia y que debe ser seguida por el alumno.

h) Paquete – conjunto de 1, 4 u 8 lecciones

i) Capítulo – unidad de división de un curso, que consta de un mínimo de 3 subcapítulos.

j) Plataforma Educativa – la página web de la Escuela de Idiomas UP2 Academy ubicada en https://edu.up2academy.com/, que contiene ejercicios para cada Módulo y el registro de actividades del Estudiante.

k) Semestre – un periodo de 6 meses contados a partir de la fecha de la primera lección o reserva de pago/transferencia

l) Mes – un período de 30 días, contado desde la fecha de la primera lección en un paquete determinado hasta su finalización.

m) Período de Transición – período válido desde el final de un paquete determinado hasta el comienzo del siguiente, que puede oscilar entre un mínimo de uno y siete (7) días, contado a partir de la fecha de la última lección de un paquete y/o desde la fecha de caducidad del paquete.

n) No Show – término que describe la falta de presentación a la hora programada para la lección sin información previa sobre su cancelación, lo que equivale a considerar la lección como aprobada.

o) Late Cancel – término que describe la cancelación o el aplazamiento de una lección programada en menos de 12 horas desde su hora de inicio.

p) UP2 Booking – sitio web que permite reservar fechas de clases de forma independiente, así como ver la disponibilidad de fechas, ubicado en: booking.up2academy.com.

q) cociente – un indicador que determina el número de lecciones multiplicado por el precio estándar

r) Soporte Duradero – un mensaje electrónico enviado a la dirección electrónica del Cliente proporcionada durante el Pedido, que permite al Proveedor de Servicios proporcionar al Cliente información sobre el Pedido, que puede ser recuperada de forma inalterada en el

s) Pedido – una declaración del Cliente presentada a través del sitio web de la Escuela de Idiomas UP2 Academy ubicado en https://www.up2academy.com/, expresando la voluntad de celebrar un contrato para la prestación de servicios educativos.

t) Acuerdo – un acuerdo para la prestación de servicios en el sentido de las disposiciones del artículo 1254 del Código Civil español, celebrado por el Proveedor de Servicios con el Cliente a través de la comunicación a distancia, incluyendo correos electrónicos y formularios disponibles en el sitio web de la Escuela de Idiomas UP2 Academy.

u) UP2 Shop – una plataforma de tienda en línea que ofrece cursos de idiomas de UP2 Academy y permite pagos en línea mediante transferencia bancaria, Blik, tarjetas de crédito y GPay.

§2 Disposiciones generales

1. El propietario de la escuela de idiomas UP2 Academy es Przemyslaw Wajrak que lleva a cabo la actividad empresarial bajo el nombre UP2 Academy con domicilio social en Calle Oviedo 121/2D, 50007 Zaragoza, España, NIF: Z0843143Z; dirección de correspondencia en Polonia: Skrzynice Pierwsze 101, 23-114, Jablonna; NIF: 7133006732; REGON: 385494334; teléfono: +48 883 119 228, correo electronico: p.wajrak@up2academy.com
2. Antes de utilizar los Servicios ofrecidos por UP2 Academy, usted debe leer todas las disposiciones de estos Términos y Condiciones, los cuales pueden ser descargados, guardados e impresos. El uso de los Servicios ofrecidos por UP2 Academy implica la aceptación de este Reglamento y de la Política de Privacidad. La condición para realizar un pedido (concluir un acuerdo) es la confirmación previa de familiarización con el contenido del Reglamento.
3. El presente Reglamento se dicta, entre otros, sobre la base del Real Decreto Legislativo 1/2007, en especial el art.103–107 (modificado por la Ley 3/2014).
4. Estos Términos y Condiciones contienen los términos y condiciones para la celebración de Contratos de venta de Servicios de UP2 Academy. El Proveedor de Servicios se reserva el derecho de cambiar los precios de sus Servicios, introducir nuevos Servicios en su oferta, realizar, cancelar o introducir cambios en las campañas promocionales en el sitio web del Proveedor de Servicios ubicado en https://www.up2academy.com/. El derecho mencionado en la primera frase no afecta a la eficacia, el modo de ejecución y el precio de las órdenes y campañas promocionales realizadas con anterioridad. §3 Términos y condiciones de los servicios prestados por UP2 Academy

1. Requisitos técnicos

1. Para el correcto uso de los Servicios de UP2 Academy, es necesario lo siguiente:
   a) Ordenador de sobremesa/portátil/dispositivo móvil;
   b) Acceso a Internet – velocidad mínima – 500 kbps;
   c) Navegador web – se recomienda la última versión: Chrome, Mozilla, Firefox, Microsoft Edge y Safari (versión 7 o superior), Internet Explorer (versión 10 o superior);
   d) Webcam;
   e) Micrófono y altavoces o auriculares;
   f) Software adecuado para participar en la clase – Skype con una cuenta activa y para contactar con el Proveedor de Servicios – Whatsapp;
   g) Cuenta de correo electrónico activa (se recomienda Gmail)
2. El Cliente/Estudiante deberá verificar todos los requisitos técnicos antes de adquirir el Servicio, ya que el Proveedor de Servicios no es responsable de ningún fallo de hardware o software por parte del Cliente/Estudiante.

2. Tipos de cursos y servicios prestados por el Proveedor de Servicios

La escuela de idiomas UP2 Academy ofrece los siguientes tipos de cursos:

1. Clases particulares: clases totalmente personalizadas en un paquete de 1/4/8
2. El Proveedor de Servicios, como parte del curso especificado en a. proporcionará además a los Estudiantes:
   a) acceso ilimitado a la plataforma de aprendizaje 24 horas al día, 7 días a la semana;
   b) supervisión del profesor y seguimiento del progreso del alumno (también a través de la plataforma de aprendizaje);
   c) lecciones de recuperación adicionales, ofrecidas por recomendación del profesor, para aclarar dudas, practicar un tema específico y prepararse mejor para la siguiente lección dentro del paquete de lecciones adquirido;
   d) la posibilidad de realizar una prueba gratuita para comprobar el nivel de competencia del alumno;
   e) horario flexible y posibilidad de reservar clases casi a cualquier hora (también los fines de semana en el caso de un paquete de 1 clase);
   f) material didáctico incluido en el precio;g) cancelación o reprogramación de las clases – para más detalles, véase el punto IV del §3.
3. Las clases individuales se imparten en una de las 5 modalidades:
   a) General English: aprendizaje de inglés general en niveles que van desde el básico (A1, A2, A2+), pasando por el intermedio (B1, B1+, B2, B2+), hasta el avanzado (C1, C1+, C2).;
   b) Business English: inglés comercial, de nivel básico a avanzado;
   c) Exam Course: un curso de examen para los candidatos que deseen presentarse a uno de los exámenes de idiomas de Cambridge: Preliminary (B1), First (B2), Advanced (C1), Proficiency (C2) y para los estudiantes que cursen el Bachillerato (Primary y Extended);
   d) Speaking: clases con énfasis en la expresión oral: mejora de la pronunciación, aprendizaje de técnicas de fluidez, eliminación de los errores léxicos y gramaticales más comunes, adquisición de confianza, preparación de entrevistas y autopresentación;
   e) Individual: actividades totalmente personalizadas y a medida que van más allá del ámbito de los cursos anteriores (tutoría de material actual de la escuela o la universidad, lenguaje profesional, asistencia metodológica para TKT, CELTA, cursos Delta).
4. El estudiante debe elegir la modalidad adecuada antes de comenzar el curso y, en caso de duda, debe pedir consejo al profesor durante la reunión de organización. El cambio de modalidad durante/después del curso sólo es posible previa consulta con el profesor y se considera caso por caso.

3. Método

1. El Destinatario del Servicio/alumno acepta y se compromete a seguir el método de UP2 Academy y las recomendaciones del profesor para conseguir los mejores resultados. No seguir el método y/o las recomendaciones del profesor puede resultar en un progreso ineficaz, del cual el Proveedor de Servicios no es responsable.
2. El método de UP2 Academy consiste en: lecciones en directo en línea, ejercicios en la plataforma de aprendizaje y lecciones adicionales opcionales en directo en línea.
3. Durante la clase en línea en directo, el alumno conocerá y practicará el material gramatical y léxico de la sección correspondiente del capítulo bajo la supervisión del profesor. Después de la lección, el estudiante se conecta a la plataforma de aprendizaje para continuar aprendiendo y completar ejercicios de comprensión oral, lectura y escritura, así como tareas gramaticales y léxicas, y para ver y resolver tareas de la sección Real English. Después de la lección, el Alumno tiene la oportunidad de concertar una cita para la siguiente lección.
4. Una vez resueltas todas las tareas de las secciones correspondientes, el Alumno pasa a la lección de la subsección siguiente, tras lo cual continúa la práctica en la plataforma de aprendizaje (véase el punto 3).
5. Durante cada lección, el alumno demuestra los conocimientos y muestra las habilidades adquiridas en lecciones y ejercicios anteriores en la plataforma de aprendizaje. Durante la lección, el profesor evalúa la capacidad lingüística del alumno en términos de estructuras gramaticales utilizadas, vocabulario, precisión, fluidez e interacción general.
6. El proceso de aprendizaje es idéntico en los cursos Inglés General, Inglés Comercial y Curso para Exámenes. En el caso de los cursos Speaking e Individual, el proceso depende de las expectativas y necesidades del alumno y se determina durante las clases de organización y/o las primeras lecciones.
7. Cada cierto número de Capítulos, el Alumno realizará tareas de repetición y hará un test para comprobar sus progresos y decidir si continúa con el siguiente subcapítulo o Capítulo. Por otra parte, si los resultados no son al menos suficientes, el profesor puede sugerir una repetición de parte del material o una lección de seguimiento.
8. Cada clase se basa en los principios detallados del método UP2 Academy, que se caracteriza por:
   a) comunicativo: el aprendizaje tiene lugar a través de la conversación, los juegos de rol y el debate, sin necesidad de aprender las reglas de memoria;
   b) inmersión: las clases y la interacción tienen lugar 100% en inglés;
   c) practicidad: lecciones y tareas contextualizadas;
   d) enfoque individual: la forma de impartir las clases se adapta al nivel y a los intereses del alumno;
   e) desarrollo de las competencias lingüísticas: además de hablar, practicamos la comprensión oral, la lectura y la escritura, que son elementos esenciales del dominio de la lengua;
   f) materiales originales: las lecciones en línea se basan en materiales y conjuntos de ejercicios interactivos especialmente preparados.

4. Fechas de las clases, cambios y anulaciones

1. El proveedor de servicios ofrece horarios de clase flexibles de lunes a viernes, en dos bloques: uno por la mañana y otro por la tarde. El bloque de mañana va de 7.00 o 8:00 a 12.00 y el de tarde, de 15.00 o 16:00 a 22.00. Las clases de fin de semana se imparten en el bloque de mañana, de 8.00 a 12:00 o 13.00 horas.
2. El alumno tiene derecho a elegir la hora de la lección en uno de los dos bloques, teniendo en cuenta el comienzo a la hora completa. La reserva de fecha se realiza después de cada lección con el profesor, por correo electrónico, Whatsapp o por la página de reservas (UP2 Booking). Cuanto antes se haga la reserva, mayor será la elección de Es posible reservar clases con un máximo de 14 días de antelación (solo reservas col el profesor o por correo electrónico o Whatsapp) a partir del día en que se solicita la reserva. Las clases no tienen lugar durante las vacaciones o días festivos.
3. Los cambios en la reserva de una clase son ilimitados y se pueden realizar de forma gratuita dentro del curso/paquete adquirido, pero como máximo 12 horas antes del inicio previsto de la clase; hablando con el profesor después de cada clase, poniéndose en contacto con el Proveedor de Servicios por correo electrónico, Whatsapp o por la página de reservas (UP2 Booking). Cuando una reserva se modifica con menos de 12 horas de antelación a la hora de clase programada (Late Cancel), se entiende como una cancelación de la clase (véase el punto 4). Cualquier cambio de los horarios de clase previamente acordados tiene un impacto negativo en el proceso de aprendizaje y en la disponibilidad de nuevos horarios más cercanos, por lo que el Proveedor de Servicios advierte contra la realización de cambios demasiado frecuentes y desconsiderados.
4. Realizar una reserva a través del sitio web (UP2 Booking) y tener una reserva al mismo tiempo resulta en la cancelación de la fecha de la lección original y una actualización con una nueva fecha seleccionada por el Los detalles sobre la nueva fecha de la lección estarán disponibles en un correo electrónico después de la reserva.
5. La cancelación de una lección o la no llegada a la hora acordada (No Show) dará lugar a la programación de otra lección del paquete dado de 1, 4 u 8 El Proveedor de Servicios no reembolsará el coste de la lección cancelada. El Estudiante tiene derecho a cancelar las lecciones sin las consecuencias descritas en el párrafo. 3 solo una vez por paquete de lecciones comprado y activo (con la excepción de No Show). En el caso de imposibilidad de asistir a las clases por un periodo superior a 14 días, que se deba a enfermedad u otra situación fortuita ajena a la voluntad del alumno, el Proveedor de Servicios se compromete a prorrogar el contrato por el número de días especificado en el certificado médico del alumno. Todos los demás casos serán estudiados caso por caso por el Proveedor de Servicios.
6. El estudiante tiene derecho a reprogramar una lección sólo durante el periodo en el que el paquete está activo, es decir, dentro de los 30 días siguientes a la fecha de la primera lección o a la fecha en la que se acredita el pago/transferencia.
7. La cancelación de las clases por parte de un profesor durante más de 7 días debe comunicarse al alumno con suficiente antelación, entre 14 y 30 días, con la posibilidad de recuperar la clase en otra fecha, sin consecuencias y ampliando el paquete por el número de días de ausencia del profesor.
8. La cancelación de una clase por parte de un profesor con menos de 12 horas de antelación a la hora acordada debe comunicarse inmediatamente al alumno, con la posibilidad de aplazar la clase acordada a otra fecha, sin las consecuencias descritas en el apartado. 4 y con la oferta de una clase extra gratuita como compensación.
9. Los cambios frecuentes e injustificados y las cancelaciones de las clases, es decir, más de 4 veces en el transcurso de un determinado paquete de clases o la falta de contacto con el Estudiante durante más de 7 días, darán lugar a la rescisión inmediata del contrato entre el Proveedor de Servicios y el Cliente, teniendo en cuenta las normas descritas en el §7 del presente Reglamento.
10. Cualquier otro caso de reprogramación y anulación de clases no descrito en los párrs. 1-9, incluidos los casos fortuitos, se estudiarán caso por caso.

5. Suspensión del curso/paquete activo

1. El estudiante tiene derecho a suspender el curso por un período máximo de hasta 30 días, una vez por semestre, calculado a partir de la fecha de la primera lección o de la fecha en que se contabilice la transferencia/pago del semestre.
2. Un estudiante puede suspender un curso/paquete por menos de 30 días, no menos, los días no utilizados no se suman, no se trasladan al siguiente semestre y no se pueden utilizar en otro momento.
3. El estudiante está obligado a informar al Proveedor de Servicios con al menos 30 días de antelación de su deseo de suspender el curso.
4. La validez de las lecciones no utilizadas o del paquete en sí, que se hayan suspendido correctamente, se prorrogará por el número de días indicado por el Estudiante, que podrá ser de 30 días como máximo, y por el número de días que queden en el paquete antes de la fecha de inicio de la suspensión del curso/paquete.
5. El profesor, en consulta con el alumno, acordará una fecha para la suspensión y reanudación del curso, así como una fecha para la utilización de las lecciones pendientes del paquete.

6. Material didáctico

1. El proveedor de servicios proporciona material didáctico para el aprendizaje de una lengua extranjera, que está disponible en la plataforma de aprendizaje y durante la clase en formato electrónico. El alumno puede disponer o no de libros de texto o juegos de ejercicios adicionales. El proveedor de servicios recomienda llevar un cuaderno de vocabulario y notas, que ayudará a asimilar mejor el material.

7. Plataforma educativa

1. La plataforma de aprendizaje es parte integrante del método UP2 Academy. Proporciona acceso a ejercicios de comprensión auditiva, lectura, escritura, gramática, vocabulario y comprensión del lenguaje coloquial (Real English). Además, el alumno tiene la posibilidad de seguir sus progresos, comprobar sus resultados y evaluar las
2. Una vez que el estudiante ha seleccionado un curso, recibe un correo electrónico con instrucciones para crear un perfil y manejar la plataforma https://edu.up2academy.com/ por su cuenta. El acceso a la plataforma es posible 24 horas al día, 7 días a la semana. El Proveedor de Servicios se compromete a proporcionar un acceso ininterrumpido y correcto a la plataforma. En caso de irregularidades, el Estudiante deberá comunicar sus observaciones al profesor después de cada lección o directamente al Proveedor de Servicios por correo electrónico o Whatsapp.
3. El acceso a la plataforma es personal y sólo tiene derecho a él la persona que haya adquirido el curso correspondiente y cuyo paquete de cursos esté activo.

8. Diplomas y certificados

1. Una vez completado el 100% de cada módulo, el alumno puede recibir, sólo si lo solicita, por correo electrónico un certificado de finalización del módulo y con información sobre el nivel en el que se encuentra.
2. Al finalizar cada nivel, el alumno puede recibir un diploma, previa solicitud por correo electrónico únicamente, que es la confirmación del nivel adquirido y de los conocimientos lingüísticos en UP2 Academy.
3. A petición del estudiante, el Proveedor de Servicios puede enviar una versión física del diploma a la dirección postal indicada anteriormente.

§4 Conclusión del contrato

1. Método de celebración de contratos y prueba de nivel

1. La conclusión del contrato entre el Proveedor de Servicios y el Cliente y el acceso al Curso tiene lugar cuando se introducen los datos de la tarjeta de crédito/débito y se adquiere el Curso correspondiente o se recibe el importe debido y se abona en la cuenta bancaria del Proveedor de Servicios.
2. Para celebrar el contrato, el Destinatario del Servicio deberá:
   a) familiarícese con la oferta de cursos de idiomas presentada en el sitio web de UP2 Academy y con estos términos y condiciones;
   b) Haga clic en el botón “Comprar ahora” asignado al curso correspondiente o transfiera el importe adeudado a la cuenta bancaria del Proveedor de Servicios;
   c) Aceptar estos términos y condiciones para los Servicios prestados por la Escuela de Idiomas UP2 Academy;
   d) Adquiera el curso de idiomas o el paquete de clases de su elección cumplimentando y aceptando el formulario de pago (se aplica a las compras a través del sitio web), lo que equivale a la aplicación del punto 2c anterior.
3. La obligación de pago indicada en el botón “Comprar ahora” significa la obligación del Cliente de realizar un pago a UP2 Academy con el fin de celebrar un contrato de prestación de servicios por UP2 Academy.
4. Tras la compra, el Estudiante recibirá una confirmación de la celebración del Contrato, que se perfecciona con el pago del precio, grabada en un soporte duradero en la dirección de correo electrónico facilitada por el Estudiante. Al aceptar las presentes Condiciones Generales, el Destinatario del Servicio acepta recibir la mencionada confirmación fijada en un soporte distinto del El mencionado mensaje de correo electrónico contiene una confirmación relativa al tipo, nivel y duración del curso especificado, la confirmación del pago y los presentes Términos y Condiciones.
5. Un estudiante que comienza en UP2 Academy debe realizar una prueba de nivelación en línea gratuita disponible en el sitio web de UP2 Academy para determinar el nivel correcto del Los resultados de las pruebas estarán disponibles en la plataforma educativa.
6. Tanto el contrato como la obligación de pago se concluyen a tiempo indefinido hasta que el Destinatario del servicio o el Prestador del servicio realicen una declaración clara de rescisión por escrito, sin perjuicio del plazo de preaviso indicado en el artículo 7, apartado

2. Paquetes y precios

1. Las clases individuales constan de 3 paquetes de precios:
   UP2 x1 – 1 lección – precio básico 20 EUR bruto;
   UP2 x4 – 4 lecciones – precio promocional 70 EUR bruto;
   UP2 x8 – 8 lecciones – precio promocional 120 EUR
2. Los precios de todos los cursos ofrecidos por UP2 Academy son precios brutos expresados en zlotys Los precios de los cursos publicados en el sitio web de la escuela de idiomas UP2 Academy incluyen la remuneración total de UP2 Academy por la prestación de servicios, impuestos incluidos.
3. Los precios promocionales indicados en 1(b) y 1(c) sólo son válidos si se adquiere un paquete de 4 u 8 lecciones.
4. El cliente se compromete a pagar la tasa de:
   a) 20 EUR y/o el cociente según el número de lecciones seleccionadas;
   b) 70 EUR, 120 EUR y/o su cociente según el número de lecciones seleccionadas cada vez e inmediatamente por adelantado, a más tardar el día de la primera lección del paquete respectivo o en la fecha indicada en la factura.
5. Cualquier retraso en el pago se tratará caso por caso, en función de la legislación aplicable.
6. En el caso de un paquete de 1 lección UP2 x1, antes del inicio de un curso determinado, se acuerda la frecuencia y/o número de lecciones por mes y se realiza el pago por adelantado por el número de lecciones indicado. No es posible adquirir más de una lección del paquete UP2 x1 a través del sitio web.
7. Los precios de los cursos individuales definidos en §2 dependen del número de lecciones/tipo de paquete adquirido y sólo están disponibles en las siguientes configuraciones:
   a) General English – paquete de 1/4/8 lecciones, 20/70/120 EUR y/o su cociente;
   b) Business English – paquete de 1/4 lecciones, 20/70 EUR y/o su cociente;
   c) Exam Course – paquete de 1 lección, 20 EUR y/o su cociente;
   d) Speaking – paquete de 1/4/8 lecciones, 20/70/120 EUR y/o su cociente;
   e) Individual – paquete de 1 lección, 20 EUR y/o su cociente
8. El pago de un paquete determinado en euros (EUR) se aplica a los ciudadanos afuera de Polonia.
9. Los paquetes de lecciones 1/4/8 son válidos (activos) durante 30 días a partir de la fecha de la primera lección del paquete o de la fecha de abono del pago/transferencia. Las lecciones no utilizadas de un paquete determinado dentro de los 30 días siguientes a la fecha de inicio se pierden y no se recuperan ni se reembolsan.
10. Una vez transcurridos 30 días desde la fecha de la primera lección o abonada la transferencia/pago, el Alumno adquiere otro paquete para poder seguir aprendiendo y accediendo a la plataforma de aprendizaje.
11. Luego de completar la última lección de un determinado paquete y/o expirar su vigencia, existe un período de transición, que puede durar o no desde 1 hasta un máximo de 7 días, durante el cual el Estudiante está obligado a realizar un pago por el siguiente paquete de clases y reservar una fecha de lección, en un plazo no mayor a 7 días a partir de la fecha de vencimiento del último paquete.

§5 Formas de pago

1. El pago se puede realizar a través de la tienda online https://shop.up2academy.com, responsable del procesamiento de pagos en UP2 Academy, y que ofrece los siguientes métodos:
   a) El pago online se procesa a través de la pasarela de pago Paynow, gestionada por AutoPay S.A., ul. Powstańców Warszawy 6, 81-718 Sopot, NIP: 5851351185, REGON: 191781561, KRS: 0000320590. AutoPay acepta tarjetas: Visa, Visa Electron, MasterCard, Mastercard Electronic, Maestro.
   b) El pago online se realiza a través de la plataforma Stripe Payments Europe Limited, 1 Grand Canal Street Lower, Dublín, D02 H210, Irlanda, registrada con el número 513174 y supervisada por el Banco Central de Irlanda;
   c) Pago en línea a través de la plataforma Google Pay, operada por Google Payment Limited, 5 New Street Square, Londres, EC4A 3TW, Reino Unido, número de la FCA 900008.
   d) Transferencia bancaria: previa solicitud con el proveedor de servicios, al siguiente número de cuenta: (PLN) PL95 1140 2004 0000 3802 7972 1526; (EUR) ES91 2100 9723 6902 0054 5691.
2. Si tiene alguna pregunta sobre la creación de una cuenta o la realización de pagos a través de los servicios mencionados, consulte las condiciones de uso disponibles en: https://autopay.pl/; https://stripe.com/; https://pay.google.com/.
3. En caso de problemas con el pago, el Cliente deberá notificarlo inmediatamente al Proveedor de Servicios por correo electrónico: contacto@up2academy.com.
4. El estudiante está obligado a realizar los pagos puntuales de los paquetes de clases, de acuerdo con la fecha indicada en la factura.
5. Se podrán cobrar intereses de penalización por cualquier retraso en el pago de conformidad con la legislación aplicable.

§6 Derecho de retractación

1. De conformidad con el Real Decreto Legislativo 1/2007, de 16 de noviembre, un consumidor que celebre un “contrato a distancia” – tiene derecho a rescindir el contrato sin dar ninguna razón y sin incurrir en costes – en un plazo de 14 días naturales a partir de la firma del Contrato. En este caso, el Destinatario del Servicio se compromete a informar inmediatamente al Proveedor del Servicio por correo electrónico, utilizando la plantilla para la rescisión del Contrato, que se incluye en el correo electrónico de bienvenida.
2. En caso de desistimiento, el Contrato se considerará no celebrado.
3. El Proveedor de Servicios, en el plazo de 14 días desde la recepción de la declaración de desistimiento del Consumidor, reembolsará el pago realizado por el Consumidor utilizando el mismo método de pago utilizado por el Consumidor, a menos que el Consumidor acepte expresamente un método de reembolso diferente que no suponga ningún coste para el Consumidor.
4. En el caso de que el Consumidor haya solicitado expresamente que el Proveedor de Servicios inicie la prestación de los servicios antes de la expiración del plazo de desistimiento, el Consumidor será responsable del pago del servicio prestado hasta el desistimiento del Contrato. El importe en cuestión se deducirá del precio reembolsado al Proveedor de Servicios por el curso.

§7 Anulación de los servicios de la UP2 Academy

1. La rescisión del contrato de servicios una vez transcurridos 14 días desde la fecha de celebración del contrato se efectuará mediante un preaviso de 30 días a partir de la fecha de presentación del escrito de rescisión del curso/paquete.
2. En caso de que el Cliente cancele un paquete activo de lecciones individuales después de 14 días a partir de la fecha de celebración del Contrato o sin respetar el plazo de preaviso especificado en el párrafo. 1, es decir, con efecto inmediato, el Cliente está obligado a pagar una tasa de nivelación, que es la diferencia entre el precio básico y el precio promocional multiplicada por el número de lecciones del paquete en cuestión.
3. Durante el periodo de preaviso, el Estudiante tiene todos los derechos de un curso/paquete activo y el derecho a utilizar el paquete de lecciones en su totalidad, hasta que finalice el periodo de preaviso o el periodo de actividad del paquete de
4. El paquete de cursos/clases deja de estar activo al expirar el último paquete de clases y/o al expirar el plazo de preaviso de 30 días.
5. En caso de interrupción de los Servicios debido a fallos técnicos no imputables al Estudiante, el Proveedor de Servicios se compromete a compensar las molestias ofreciendo al menos una lección individual gratuita adicional, que el Estudiante podrá tomar en cualquier momento durante la vigencia del contrato.
6. Todas las reembolsos se realizan de conformidad con el punto 2 y 3 de este párrafo, a la cuenta bancaria asignada a la tarjeta o indicada por el Estudiante. En otros casos, los reembolsos no son posibles.
7. En caso de falta de contacto con el Estudiante por un período superior a 7 días, esto resultará en la terminación inmediata del contrato entre el Proveedor de Servicios y el Destinatario de Servicios, teniendo en cuenta las reglas descritas en el punto 1-4 de este términos y condiciones.
8. Reanudación de clases en la situación descrita en el punto 7 da lugar a la celebración de un nuevo contrato, en los términos y condiciones vigentes en cada momento.
9. Cualquier otro caso no descrito en los puntos 1-8, se estudiará caso por

§8 Reclamaciones

1. El cliente tiene derecho a presentar una reclamación sobre los servicios prestados por UP2 Academy.
2. Las reclamaciones deben enviarse por correo electrónico a contacto@up2academy.com o por escrito directamente a UP2 Academy, Calle Oviedo 121/2D, 50007 Zaragoza, España, o dirección de correspondencia en Polonia: Skrzynice Pierwsze 101, 23-114 Jablonna.
3. La reclamación debe incluir: datos de contacto del Cliente (nombre, apellidos, dirección de correo electrónico) y una descripción del problema que da lugar a la reclamación.
4. UP2 Academy considerará la reclamación en un plazo de 14 días a partir de la fecha de la reclamación del Cliente. La falta de respuesta por parte del Proveedor de Servicios dentro de este plazo se considerará que se ha considerado de acuerdo con la voluntad del Destinatario del Servicio.

§9 Resolución extrajudicial de litigios

1. En cumplimiento de su obligación de indicar los procedimientos extrajudiciales para la tramitación de quejas y reclamaciones, así como las normas de acceso a dichos procedimientos, el Proveedor de Servicios informa de que los Consumidores y empresarios pueden utilizar la plataforma ODR en línea establecida por la Comisión Europea para la resolución amistosa de litigios. La plataforma está disponible en: https://webgate.ec.europa.eu/odr/main/index.cfm?event=main.home.show&lng=PL. UOKIK mantiene un registro de entidades habilitadas para la resolución extrajudicial de litigios en materia de consumo en: https://uokik.gov.pl/rejestr_podmiot_uprawnionych.php.

§10 Política de privacidad

1. El responsable del tratamiento de los datos personales de los Destinatarios del Servicio que sean personas físicas es el Proveedor de Servicios, es decir, Przemysław Wajrak, quien ejerce la actividad empresarial bajo la denominación UP2 Academy Przemysław Wajrak. De conformidad con lo dispuesto en el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo, de 27 de abril de 2016 (RGPD), los datos personales serán tratados de manera lícita, leal y transparente, únicamente para los fines para los que fueron recogidos y en cumplimiento de los derechos del interesado.
2. El Administrador trata los siguientes datos personales del Cliente: nombre y apellidos, dirección de correspondencia, dirección de correo electrónico (e-mail), número de teléfono. En el caso de los Destinatarios de Servicios/Estudiantes que deseen que se emita una factura, el Administrador también procesa otros datos necesarios para emitir una factura con IVA, es decir, nombre del comprador, dirección, número de identificación a efectos del IVA.
3. El suministro de los datos anteriores es voluntario, pero necesario para realizar un Pedido y concluir un Contrato de Servicios.
4. La base jurídica para el tratamiento de los datos personales es el artículo 6, apartado 1, letra b) del RGPD: el tratamiento es necesario para la ejecución de un contrato de prestación de servicios en el que el destinatario del servicio es parte o para adoptar medidas a petición del destinatario del servicio antes de la celebración del contrato.
5. El Administrador garantiza al Cliente el ejercicio de los derechos que le reconoce la legislación vigente en materia de protección de datos, en virtud de la cual el Cliente tiene derecho a acceder al contenido de sus datos, a rectificarlos, a suprimirlos (derecho al olvido), a limitar su tratamiento, a la portabilidad de los datos, a oponerse al tratamiento de sus datos personales.
6. Los datos personales del Destinatario del servicio sólo podrán comunicarse a terceros en la medida en que sea necesario para la ejecución del contrato de servicios. Los destinatarios de los datos personales del Cliente podrán ser empresas de procesamiento de pagos en línea y proveedores de servicios informáticos del responsable del tratamiento.
7. Los datos personales del destinatario del servicio se almacenarán durante un periodo de 10 años o hasta que el destinatario del servicio solicite su supresión.
8. Si se considera que el tratamiento de datos personales infringe el Reglamento RGPD de la UE, el destinatario del servicio tiene derecho a presentar una reclamación ante la Autoridad de Control (Presidente de la Oficina de Protección de Datos Personales).
9. El destinatario del servicio acepta recibir las notificaciones necesarias sobre clases o asuntos organizativos por correo electrónico o mediante mensajería instantánea y

§11 Derechos de autor

1. Todo el material educativo disponible en sitios web y la plataforma educativa de dominio de internet com, está protegido por la Ley de Derechos de Autor y Derechos Conexos (Diario de Leyes 2018, punto 880) y el Real Decreto Legislativo 1/1996, de 12 de abril.
2. Estos materiales solo pueden ser utilizados por personas que los compraron o compraron un paquete de El alumno tiene derecho a imprimir y utilizar estos materiales únicamente con fines educativos y para uso personal.
3. Si el Estudiante desea utilizar cualquiera de los elementos de sitios web de UP2 Academy para fines que no sean educativos y de uso personal, el Estudiante debe hacer una solicitud por escrito al Proveedor de Servicios para obtener permiso para utilizar los materiales en cuestión.
4. El Proveedor de Servicios se reserva el derecho de modificar y mejorar el contenido del Curso durante el transcurso del mismo.
